All Out Hobbys – Sell to Us Terms & Conditions

These Terms & Conditions apply when you submit Pokémon trading cards or other items accepted by us for valuation and possible purchase through the All Out Hobbys “Sell to Us” service.

Please read these Terms before sending any items to us. By submitting the Sell to Us form and confirming your agreement to these Terms, you agree to be bound by them.

1. Who we are

“All Out Hobbys”, “we”, “us” and “our” refer to All Out Companies Ltd trading as All Out Hobbys, registered in England and Wales under company number 12808593.

2. Who can use the service

You must be 18 years of age or older to submit cards to us.

By submitting cards, you confirm that:

  • you are aged 18 or over;

  • you are the legal owner of the submitted items, or have the legal owner's authority to sell them;

  • you have the legal right to offer the items for sale;

  • the items have not, to the best of your knowledge, been stolen, obtained through fraud or otherwise unlawfully acquired; and

  • to the best of your knowledge, any cards represented as genuine Pokémon Trading Card Game products are genuine and are not counterfeit or replica products.

We may request photographic identification, proof of address or evidence of ownership where we reasonably consider this necessary, including for higher-value or unusual submissions.

We may refuse or suspend a submission if reasonable verification requested by us is not provided.

3. Nature of our valuation and offers

All Out Hobbys is purchasing cards for commercial resale.

Our valuation is therefore a commercial purchase offer and not an independent appraisal of the retail or market value of your collection.

Our offers may be below prices achieved through private sales, marketplaces, auctions or retail sales because our offer takes account of matters including:

  • card condition;

  • authenticity;

  • current demand;

  • recent market prices;

  • expected resale value;

  • selling fees;

  • processing and handling costs;

  • stock levels;

  • the time required to catalogue and sell the cards; and

  • the commercial margin required by us.

You are under no obligation to accept an offer.

4. Estimates before cards are received

Any price, estimate, indication or buying rate provided before we physically receive and inspect your cards is indicative only.

Photos, descriptions and card lists cannot always accurately establish authenticity, condition, edition, quantity or value.

No estimate given before physical inspection constitutes a binding offer to purchase the cards.

Where bulk cards are quoted using a per-card or per-category buying rate, the final amount will be based on the quantities and categories we actually verify after receipt.

5. Sending cards to us

Unless we expressly agree otherwise, you are responsible for arranging and paying for postage or delivery of your cards to us.

You are responsible for:

  • packaging cards securely;

  • choosing an appropriate postal or courier service;

  • obtaining proof of postage;

  • ensuring that the level of carrier compensation or insurance is appropriate for the value of the submission; and

  • providing accurate contact and return-address information.

We strongly recommend using a tracked service.

We are not responsible for loss or damage occurring before the parcel has been delivered to us.

Nothing in these Terms limits our responsibility for loss or damage caused by our failure to exercise reasonable care once the items are in our possession.

6. Receipt and inspection

Once received, we may:

  • count the cards;

  • sort them;

  • inspect their condition;

  • inspect them for authenticity;

  • identify sets, variants and editions;

  • remove cards from sleeves, binders, toploaders or other holders where reasonably necessary;

  • separate cards into different value or condition categories; and

  • compare them with market information and recent sales data.

Because bulk submissions may need to be sorted during valuation, we cannot guarantee that cards will be returned in exactly the same order or arrangement in which they were received.

We will take reasonable care of cards and reusable accessories while they are in our possession.

Disposable outer packaging used to ship the submission may be recycled or discarded where reasonably necessary. Personal binders, cases or other reusable items will remain your property unless they are expressly included in an accepted purchase offer.

7. Condition

All cards are valued according to the condition determined during our physical inspection.

Our assessment may differ from the condition stated by you or another person.

Factors may include, without limitation:

  • whitening;

  • scratching;

  • dents;

  • creases;

  • bends;

  • staining;

  • edge wear;

  • surface damage;

  • print defects;

  • water damage;

  • alterations;

  • writing;

  • damage to corners;

  • centring where relevant to value; and

  • other physical defects.

Our condition assessment is used to determine our purchase offer. It is not a professional grading service and does not guarantee that a grading company or another buyer would give the card the same condition assessment.

8. Postage reimbursement when an offer is accepted

You are responsible for the initial cost of sending your cards to us.

If you accept our final purchase offer, we will reimburse your reasonable actual standard postage cost up to a maximum of £10 per submission, unless a different amount has been agreed with us in writing before posting.

We may require reasonable evidence of the postage cost, such as a postage receipt, shipping label or tracking confirmation.

The reimbursement is limited to the actual amount paid for reasonable postage. Optional premium delivery services, additional insurance or other additional charges will not be reimbursed unless agreed by us in advance.

The postage reimbursement will be shown separately from the purchase price of the cards.

For example:

Card purchase price: £100.00
Eligible postage reimbursement: £6.49
Total payment: £106.49

No postage reimbursement is payable where an offer is rejected.

9. Final offer

After inspection, we may issue you with a final offer.

Where appropriate, the offer may include:

  • a monetary purchase price; and/or

  • an enhanced Store Credit option.

A reference to a “cash offer” on our website means a monetary offer paid by bank transfer. We do not normally make physical cash payments.

Unless stated otherwise in the offer, your final offer will remain available for 7 calendar days from the date it is sent to you.

You may accept or reject the offer during this period.

Silence or failure to respond does not constitute acceptance.

We reserve the right to withdraw an offer before acceptance where we identify a genuine error, suspected fraud, ownership issue, authenticity issue or other material problem with the submission.

10. Accepting an offer

An offer is accepted when you clearly communicate acceptance using the method provided by us, such as through our online system or by written confirmation.

Once an offer has been accepted, a binding agreement for us to purchase the relevant items is formed.

Ownership of the purchased cards will pass to us when the agreed payment has been made or the agreed Store Credit has been issued.

Once payment has been completed and ownership has transferred, we may resell, grade, package, alter, combine, separate or otherwise deal with the cards as their owner.

You should therefore only accept an offer once you are satisfied that you wish to sell the cards.

11. Payment

Monetary payments are made by bank transfer to the bank details supplied by you.

You are responsible for providing accurate payment information.

We aim to initiate payment within 3 working days after acceptance of the final offer and receipt of all information reasonably required to make payment.

Where Store Credit is selected, the amount of Store Credit will be stated in the offer before you accept it.

Once Store Credit has been issued in exchange for an accepted purchase offer, it cannot normally be exchanged for cash unless required by law or expressly agreed by us.

12. Rejecting an offer

You are free to reject our final offer.

If you reject it, the cards remain your property.

You will be responsible for:

  • arranging collection where collection has been agreed by us; or

  • paying the reasonable cost of returning the cards to you.

We will provide details of the applicable return-postage cost.

Return postage must normally be paid before the cards are dispatched.

Where appropriate, you may request a higher level of postal insurance or compensation at your own cost.

If we decide not to make an offer for our own commercial reasons and your submission otherwise complies with these Terms, we will normally cover reasonable standard return postage.

This does not apply where we terminate or reject the submission because of counterfeit goods, materially inaccurate information, prohibited items, suspected fraud, ownership concerns or another breach of these Terms.

13. Seven-day collection and return period

Once:

  • you reject our offer;

  • our offer expires without acceptance; or

  • we notify you that the submission is available for return,

you must arrange and, where applicable, pay for return postage or agreed collection within the applicable 7-calendar-day period.

Where an offer is issued and you do not respond, this period will run from the date the offer was sent.

Where you reject an offer before the end of the 7-day offer period, the return-arrangement period will continue until the original 7-day deadline unless we give you additional time.

We may extend or waive a deadline where we consider it reasonable to do so, particularly where you remain in communication with us.

14. Storage charges

We have limited storage space and cannot hold rejected or uncollected submissions indefinitely.

If, after the applicable 7-calendar-day period, you have not arranged and paid for return postage or completed an agreed collection arrangement, we may charge a storage fee of:

£5 per week or part of a week, starting on day 8.

For example, if the applicable 7-day period expires on a Monday, the first storage period begins on Tuesday.

The storage charge is intended to contribute towards the reasonable administration, handling and storage costs created by uncollected submissions and is not intended to operate as a penalty.

Unless exceptional storage requirements have been expressly agreed with you, storage charges under this provision will be capped at £50 per submission.

We may waive some or all storage charges at our discretion, including where you have remained in reasonable communication with us and there is a genuine reason for a delay.

You remain responsible for return postage in addition to any properly due storage charges.

15. Uncollected cards

Your cards do not automatically become our property simply because you fail to arrange their return.

Where cards remain uncollected, we may exercise any rights available to us under the Torts (Interference with Goods) Act 1977, including the statutory procedure relating to uncollected goods.

Where required, we will provide written notice identifying the goods, where they are held, any amount properly due and the steps required for their return.

Where we intend to exercise a statutory power of sale and an amount became payable to us in respect of the goods before the notice is given, we will provide the minimum notice required by law, which may be at least three months.

Any statutory notice of intention to sell will be served in the manner required by applicable law.

If the statutory requirements have been satisfied and the goods remain uncollected, we may sell the goods.

Where we sell uncollected goods under a statutory power, we will account for the proceeds as required by law. We may deduct amounts that the law permits us to deduct, including applicable costs of sale and qualifying amounts properly due to us.

We will use a method of sale that is reasonable in the circumstances.

If you dispute an amount we claim is payable in relation to the goods, you should contact us immediately. We will deal with any statutory sale procedure in accordance with the applicable law relating to disputed charges.

Nothing in these Terms gives us a general right simply to confiscate or take ownership of uncollected cards.

16. Counterfeit, fake and replica cards

We only purchase genuine products unless we have expressly stated otherwise.

We understand that sellers may occasionally possess a counterfeit card without knowing that it is counterfeit.

Where we identify an isolated or small number of suspected counterfeit or replica cards, we may:

  • exclude them from the valuation;

  • assign them no purchase value; and

  • continue valuing the remainder of the submission.

However, where:

  • counterfeit or replica cards form a significant part of the submission;

  • the nature or quantity of counterfeit cards makes it unreasonable for us to continue processing the collection; or

  • we reasonably believe counterfeit cards have knowingly or deliberately been submitted as genuine,

we may stop the valuation and reject the entire submission.

Where we terminate a valuation for one of these reasons, a £10 counterfeit-submission processing fee may be payable to contribute towards the reasonable inspection and administration work already carried out.

This fee will not normally be charged merely because an isolated counterfeit card is discovered where we continue processing the remainder of the submission.

You will also be responsible for reasonable return postage where the submission is terminated because of counterfeit cards.

Our decision that a card is suspected to be counterfeit is an assessment for the purposes of deciding whether we are willing to purchase it. It is not a declaration by a court or law-enforcement authority.

We will not knowingly purchase or resell counterfeit Pokémon cards as genuine products.

Where we reasonably suspect criminal activity, fraud, theft or commercial dealing in counterfeit goods, we may report the matter to the police, Trading Standards or another appropriate authority.

We will only retain or surrender goods to an authority where we are legally required or otherwise lawfully entitled to do so.

17. Suspected stolen goods and ownership disputes

If we reasonably suspect that cards may have been stolen, fraudulently obtained or submitted without the owner's permission, we may:

  • suspend the valuation;

  • suspend payment;

  • request proof of identity or ownership;

  • refuse the submission; and/or

  • contact the police or another appropriate authority.

We will not knowingly purchase stolen goods.

If a third party makes a credible ownership claim before payment is completed, we may pause the transaction while the matter is investigated.

Submitting cards that you do not own or do not have authority to sell may expose you to legal liability.

18. Items we do not purchase

We may refuse any item that does not meet our current purchasing requirements.

Our purchasing categories and buying requirements may change from time to time.

Unless expressly agreed otherwise, we are under no obligation to purchase every item submitted to us.

Items that we may exclude include counterfeit products and items that cannot reasonably be authenticated or valued.

Where we decline an otherwise compliant submission solely because we choose not to purchase it, clause 12 regarding return postage will apply.

19. Errors in quantities or descriptions

You should provide information about your submission as accurately as reasonably possible.

An approximate quantity is acceptable where the Sell to Us form permits one.

The final offer will be based on the items actually received and verified by us.

We are not bound by an estimate based on:

  • an incorrect card count;

  • incorrect card identification;

  • an incorrect set or edition;

  • an inaccurate condition description;

  • duplicate or missing cards;

  • cards shown in photographs but not subsequently received; or

  • information that is otherwise materially inaccurate.

If we discover a genuine administrative or calculation error in our final offer before payment has been completed, we will tell you as soon as reasonably possible and provide a corrected offer.

20. High-value cards

We may apply additional checks to unusually valuable submissions.

These checks may include:

  • additional authenticity inspection;

  • requesting identification;

  • requesting proof of ownership;

  • obtaining additional internal opinions on authenticity or condition; and

  • photographing or recording the condition of the cards for transaction-security purposes.

These checks are intended to protect both you and us.

21. Our responsibility while cards are in our possession

We will take reasonable care of your cards while they remain your property and are in our possession.

We are not responsible for:

  • damage that existed before we received the cards;

  • normal condition issues discovered during inspection;

  • loss or damage occurring during inbound transit before delivery to us;

  • inaccurate information supplied by you; or

  • events outside our reasonable control,

except where the law makes us responsible.

Nothing in these Terms excludes or restricts liability that cannot legally be excluded or restricted, including liability arising from fraud or fraudulent misrepresentation.

22. Communications

We will normally communicate with you using the email address, telephone number or other contact details supplied with your submission.

You are responsible for ensuring that these details are accurate and for checking communications from us, including spam or junk folders where appropriate.

You must provide a valid full postal address before sending cards to us.

Please tell us promptly if your address, email address or telephone number changes while we are holding your cards.

23. Personal information

We will process personal information provided through the Sell to Us service for purposes including:

  • administering your submission;

  • communicating with you;

  • verifying identity or ownership where reasonably necessary;

  • making and recording payments;

  • fraud and crime prevention;

  • keeping transaction and accounting records; and

  • meeting our legal and regulatory obligations.

We will only retain personal information for as long as reasonably necessary for the purposes for which it was collected or as required by law.

24. Complaints and disputes

If you have a concern about a valuation, payment, return, storage charge, authenticity decision or any other aspect of the Sell to Us service, please contact:

Please include your name and submission reference where available.

We will try to resolve complaints reasonably and promptly.

These Terms do not affect any legal rights that cannot be excluded or restricted by contract.

25. Changes to these Terms

We may update these Terms from time to time.

The version that applies to your submission will normally be the version that you agreed to when submitting your Sell to Us form.

We will not retrospectively impose materially less favourable terms on a submission that has already been accepted by us unless required by law or agreed with you.

26. If part of these Terms is unenforceable

If any part of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply so far as legally possible.

27. No waiver

If we do not immediately exercise a right available to us under these Terms, this does not necessarily mean that we have waived that right.

28. Governing law

These Terms are governed by the laws of England and Wales.

Nothing in this clause removes any mandatory consumer rights that apply to you because of where you live.
